Mainstay Santa Ana Concrete, concretesantaana.com, team@concretesantaana.com

Agreeing to these terms

These terms cover your use of the Mainstay Santa Ana Concrete website and any estimate, scheduling or work you arrange with us through it. By using the site, asking for an estimate or booking a job, you agree to them.

If you don't agree, please don't use the site. You can still call us at (657) 643-0084 with questions before you decide anything.

When we sign a written contract with you for a specific job, that contract controls wherever it differs from these terms.

What we do

Mainstay Santa Ana Concrete is a concrete contractor based in Santa Ana, CA. We pour and repair driveways, patios, sidewalks, steps, pool decks, garage floors, footings, slab foundations, retaining walls and decorative and stamped concrete, and we cut and raise concrete. We work in Santa Ana and the cities around it.

The descriptions on our home page and service pages are general. They explain how this kind of work usually goes and aren't a promise about your property, because we only know what your job needs once we've seen it. You can read more about who we are on our About page.

Estimates and pricing

Our estimates are free, in person and carry no obligation. We give you a written price after we've looked at the site, measured, and checked the ground and where the water runs.

An estimate is based on what we can see that day. If we open up the job and find something hidden, like soft or wet ground under the old slab, buried debris, roots or old concrete thicker than expected, we stop, show you, and agree on any change in writing before we do the extra work.

Prices on an estimate hold for the period written on it. After that, material costs may have moved, so we'll confirm the price again before we schedule.

Nothing on this website is a price quote for your job.

Scheduling, weather and cancellation

We set a pour date once you've accepted the estimate. That date can move for rain, extreme heat, high wind, material delivery or a permit or inspection the job is waiting on, because pouring in the wrong conditions makes a weaker slab. We'll tell you as soon as we know and pick the next good date with you.

If you need to cancel or reschedule, call us as early as you can. If we've already ordered concrete, rebar or forms for your job, or the crew is on site, you may be charged for those costs. Your written agreement spells out the amount.

New concrete needs time to cure, the wait while it hardens and gains strength, before you walk or drive on it. We'll tell you how long for your job. Using it sooner than we say can damage it, and that damage isn't covered by us.

Your part of the job

You agree to give us safe access to the work area and to tell us what you know about buried lines, sprinklers, drainage problems and property lines. Please move cars, furniture, pots and anything else that's in the way before the crew arrives.

Whether a job needs a permit depends on the work and on your city. Your written agreement says who arranges any permit the job needs. If your property has a homeowners association, getting its approval is your responsibility.

Payment

Your written agreement sets the payment schedule, including any deposit and when the balance is due. Any deposit we ask for follows California law for home improvement contracts.

Payment is due on the dates in your agreement. If a balance goes unpaid, we may pause further work and use the remedies California law gives contractors, including a lien on the property.

Warranty and what concrete does on its own

Any warranty on our work is the one written in your contract, and only that one. This website doesn't add a warranty or extend one.

Concrete can develop small cracks even when it's done right. We cut control joints, grooves that give the slab a planned place to crack, to keep cracks where they do the least harm, but we don't promise a slab will never crack. Hairline cracks, slight color differences between pours, and normal wear on a broom finish, the light texture that gives you grip, aren't defects.

Our warranty doesn't cover damage from loads heavier than the slab was built for, use before it has cured, de-icing salts, tree roots, ground movement or earthquakes, drainage changes made after we leave, or work done by others.

Apart from any written warranty in your contract, the website and its contents are provided as they are, without other warranties, to the extent the law allows.

Limits on our liability

To the extent California law allows, Mainstay Santa Ana Concrete isn't liable for indirect or consequential losses, such as lost use of your driveway while it cures, beyond what your contract provides. Our total liability for any job is limited to the amount you paid us for that job.

Nothing in these terms limits your rights under California law that can't be waived, and nothing limits our responsibility for our own negligence where the law doesn't allow it.

Settling a problem

If something about our work isn't right, call us first. Most problems get fixed fastest when we come out, look at it with you and agree on what to do.

If we can't settle it that way, we both agree to try mediation in Orange County before going to court. Either of us can still bring a claim in small claims court when it qualifies.

California law applies

These terms and any work we do for you are governed by the laws of the State of California. Any court case that goes ahead will be heard in the courts of Orange County, California.

Using this website

Information you send through our contact form is used to answer you and arrange your estimate. We try to keep the site accurate, but it can contain mistakes or go out of date, and we may change it at any time.

We may update these terms from time to time. The version on this page when you use the site or book a job is the one that applies. A job already under a signed contract stays under that contract.
